Elisa McCutcheon is the principal of IP Link – registered to practice as a Patent and Trade Mark Attorney in Australia and New Zealand. She is also a solicitor and is admitted to practice in the Supreme Court of Queensland, Supreme Court of Victoria, Federal Court and High Court of Australia.
Elisa is a Fellow of the Institute of Patent & Trade Mark Attorneys of Australia and a member of the Queensland Law Society.
Elisa advises on patents, designs, trademark and copyright matters together with associated issues in competition and consumer law. She has extensive experience working for corporate clients, local and overseas, in a wide range of fields, including apparel, sporting goods, eyewear, pharmaceuticals and nutraceuticals, vitamins and herbal products, organic products, essential oils, perfumery and cosmetics, chemicals, agricultural products, pesticides, medical devices, life sciences, software, transport and logistics.
Elisa advises on validity and enforcement of IP rights, and is particularly well known for her work in contested IP matters. She is an experienced advocate in court and opposition proceedings. She is also experienced in alternative dispute resolution.
She is an expert in the filing, prosecution and registration of trade mark, design and patent applications throughout the world including International Applications under the Madrid Protocol and Patent Co-Operation Treaty (PCT) together with the associated practice and procedure of intellectual property offices in Australia, New Zealand and overseas territories.
She has particular expertise in the protection of well-known trade marks, strategic planning and anti-counterfeiting strategy.
She has also had in-house experience, working as a patent and trade mark attorney in a pharmaceutical research and development organisation.
